  • No waiting time of the I-130 for the Green Card Holder??

    Hi, everyone,

    I just heard a news from my lawyer that there is no waiting time for the green card holder who apply the I-130 after 08/01/2013. I checked on the USCIS homepage but failed find any notice regarding that. So, is that ture? Anyone has offical source that can prove that news? More details are totally appreciate.

    I have been researching on this as well. According to the Visa Bulletin for August, priority date for F2A beginning August is current.

    It would be a relief though, if an expert stepped in to shed light on this. I am fumbling through immigration information and hoping this news means my petition for my spouse will be sooner than 3 years.

      That would be a good news if its true. Im also trying to search on that since my husband is presently in the process of filing I-130 for me.

        Yes it is true!
        As of August 2013 all F2A categories applicants are current.


        But does that mean you can submit the I-485 even if the I-130 has not been approved but submitted (ie still in initial review phase)?

          I submitted mine along with the i485....it was accepted on the 5th of august and its still in the same phase...

                  This discussion can reflect two types of immigrants:

                  1. spouse of U.S. citizen..."immediate priority," and the I-130 can be submitted with the I-485, without the I-130 being approved.
                  2. Spouse of Green Card holder, not "immediate priority," but visa quota is "caught up" and there is no wait for an available visa slot. There is no particular reason for you to wait for the I-130 to be approved, i.e., the I-130 and I-485 can be submitted at the same time, and will be processed together, SO LONG AS THAT OF IMMIGRANT, SPOUSE OF GREEN CARD HOLDER, is "clear" for available visa slot.

                  My advice, however, would be to submit the I-130 first, get the receipt Notice of Actin showing the visa class, F2A, for which the Priority Date is now reachable, then submit the I-485 pacakge (if the spouse is currently in the U.S.).

                  The reason I recommend waiting until you have the Receipt Notice of Action (I-797) is if the quota status changes on short notice and your spouse is not "reachable," the whole package will be rejected and returned to you.
