I am a Romanian national, 35-yr old unmarried man who has lived in US for more than 14 beautiful years with green card. Initially I was granted admission in US as a son of an asylee. I graduated high school and college in US, held good jobs and paid taxes. In 2010 I returned to Bucharest to take care of my 2 maternal grandparents, in their early eighties, who were very sick. My mother could not go as she worked for the federal government at the time and has health restrictions when flying. My grandparents passed away in 2011 and 2012 respectively. In 2011 my green card expired. I knew its expiration date except I could not find it to have it renewed. I found my green card recently when I was cleaning the grandparents' apartment trying to get rid of old, unused stuff. I have nobody left in Romania, nothing to look forward to. My parents, who retired from working for the government in 2011, relocated from VA to AZ. They are US citizens for quite a while and they need me.
I am still in Bucharest trying to return to US. I just found out from the Consulate here that my returning resident DS-117 application was turned down. Please advise as to what are my options at this juncture.
Also please tell me how long do I have to wait if my mom re-petitions me. Does it matter that I am a green card holder even if expired? I mean does this shortens the wait-time period for the petition to be approved? I see in the US State Dept Visa Bulletin that they are working on family petitions dated 2006. Would I have to wait 7 years to get this petition approved or would it be less than 6 yrs considering that I once was petitioned and approved in1995?
Should I fly to US with the expired card and have an immigration judge decide my status? Can I board a plane with an expired green card in the first place?
