  • F2A current

I saw that F2A category for spouse of permanent resident is Current.
I'm Green card holder and I want to marry with my fiance in a few days. She has a tourist visa . and now, I want to know if the F2A is current ,What does it mean?
Does it mean that my future wife can get immediately her green card or it takes time? How much time need by this new law that she can get her green card?

    Thanks

Hi, I am a greencard holder who recently filed the paperwork for my husband. I can tell you my experience with the process so far and how the F2A category being current affects our case.

We filed our I-130 in March (March 11, 2013 Priority Date). Normally you would have to wait for your priority date before you can move on to the next step. I believe now that the F2A category is current you can file the I-130 and I-485 "concurrently" (The process that U.S. Citizen's follow- however it will still be longer than if you were a Citizen). However the catch is that the I-130 has to be approved before the I-485 is looked at. For us our I-130 is still in the initial review (almost 6 months later- faster for U.S. Citizens). We still need to wait for the I-130 to be approved before we can move on to the next step (I-485). However, Instead of waiting the 2 1/2 years or more for our priority date to become available we can submit the I-485 much sooner (hopefully in the next few weeks- depending on when the I-130 is approved). For us it just meant there is no waiting time in between applications- we can move on the the next step after completing the first. The approval time for I-130 for a permanent resident varies- from what I've read we are expecting between 6-8 months. We are super excited there is no waiting list because for us it means instead of this process taking over 2 1/2 years we might be looking at closer to 1 1/2 years. However- no one seems to have the perfect answer for waiting times.

My suggestion is get married and submit your I-130 ASAP and hopefully you can file "concurrently" and submit the I-485 now too which will help your process go by faster. Good luck
