  • CPSA new law....!!!!

    Hello friends.
    I have this whole messed upsituation going on so my parents get the interview letter but my younger brother name was not there we contact NVC no satisfactory answere, well he is iver 21 infact just turned 21 we did email NVC about that to expediate his process but nothing happens.. But then CPSA came and according to the calculation he is eligible but NVC ppl say that he is not and today i get to know that there are some certain amount of CPSA visa alloted and therefore he can not go along with my parents, now what about the IV fees and DS-230 which was all paid and submitted way ahaed in request of NVC... I dnt know whats going on can someone plz look up my situation and help me plz.

    Seekerpal, this is all news to me and scary. Did your parents write to both NVC and the embassy where the interview will be taking place ? As far as I am aware it is the officer during the interview that calculates CSPA and makes the final decision. Persons wanting CSPA will normally wait outside until the officer doing the interview agrees that he/she qualifies and they will either ask that he/she come in or give him/her a separate date. Did your parents interview take place already ? Your younger brother's name would not be on the letter as the decision for CSPA is made on the date of your parent's interview. This is what I have gathered from persons on this forum and other forums. I hope Aadryan or someone who went through the process can also shed some light here. Don't give up !!!!

      Butter, i understand that it will be the officer who will interveiw and decide about the eligliblelity but my question is there any kind of limitation for CSPA visa's that is scary though...
      Aadrayian plz need ur input.

        Aadriyan ... I contact my local consulate and i get this answere why they are not considering him for CSPA i cudnt undertand that ..


        Dear Applicant

        We believe that you do not qualify for a visa as you have aged out. Thus not included in the case. If you are intereste to have your situation evaluated for a visa benefit, please come to our office on the day your parents are scheduled for their interview. You will have bring in your passport, origina ID card, birth and education certificates with form FS-230. You will be required to pay a fee of US$ 230/- for your application to be review. The fee is Non Refundable.

        We hope this information is helpful.

          There is no limitation on CSPA visas. The limitation is on the category and country. What's your parents' category and from what country ?

              I read this differently than you did. First two sentences explain why your brother's name is not included, and rightly so. However, the other sentences are in preparation for him and your parents to present his case to the officer for CSPA during the interview. In fact they are telling him to come with your parents. Please ensure that he goes with all documents and please let us know the outcome. Relax !

                You misinterpreted what you read. Immigration is saying 'we decided that your brother has aged out totally BUT if your family thinks we (immigration) is wrong, your brother needs to do and bring with him the documents we listed just now to the interview with the rest of his family'.

                Just do what the letter says and your brother should be okay.

                  What is "approval date" for calculation of cspa ?
                  Is that the same as the notice date printed on I-797 notice of approval ?

                    Yes, it is. The i-797 should give the date the case is approved.
