  • F1 Family Preference

Hello, my father became a US citizen in 2000 he then made a petition for me, I arrived in April of 2000 and did not know that a visa application through the F1 Family preference would take so much time. I overstayed and I am aware that this really reduces my chances of ever getting a green card/visa . I left the US in 2009 to go to University in Ireland , now that I have graduated my application is due for processing , I always paid the fees over the years and recently when asked, I have just submitted my DS- 260 electronically and will send the civil documents whilst my father completes the I-864 affidavit form. I have received mainly some quite negative advice over the years and i am constantly told that I have a serious problem for my application based on the fact that I overstayed. However, I think in the very least I should proceed but , I would greatly appreciate any advice or thoughts on how my actual chances are ??? many thanks in advance

You will be subjected to a 10-year bar because you overstayed for more than a year. Also you have to file for a waiver at the time of your interview and this will be evaluated to determine if you will be eligible for waiver. Good luck. Keep us updated.
