married without visa
I'm an american girl who has been married to a mexican for over 2 years now.I'm really confused about this whole process, haven't filed any papers yet.He has no visa so I'm not quite sure what to do because form I-485 states that he's ineligible for adjustment of status (no visa).I'm afraid to start my I-130 because I hear he might be deported or penalized in some way.I am low income - do I need a lawyer --HELP !!!!!

Did he enter the US legally? In my experiece my husband didn't file papers with his first wife, but he did enter legally. When he and I got married I filled the paperwork and so far things have been going well. First you need to file a I-130 (Immigrant Petition for relative , fiance) you can get if off the net at /show-form/i-130 and send it in and then you can look on the website and it can tell you where to go from there.
We got an attorney b/c we were afraid he would get deported as well but all that did was put us out $1000.00.
