  • Postpone parents' GC interview or accept 221(g) denial?

    Hello,

My parents have the Green card interview scheduled at Mumbai (India) consulate on 26th November. Unfortunately, their medical exam will take some time (will get medical back December 20th), due to the TB testing (they have some old scars in the lung). Should they ask for a postponement of the GC interview (with the risk that the new date may be too far away), or should they go to the interview without the medical (knowing that they will get denied)?

I think that if they go and receive 221(g) denial, then the next interview may occur faster, than if they postponed. On the other hand, without the medical exam, they may not even be allowed to see the consular officer, which will be the worst possible scenario. Any recommendations?

They should GO for the interview on the scheduled date(ie Nov 26). All other visa issuance steps(ie formal interview, oath, signing of ds230-2, finger prints etc) will be completed on the interview day. If they don't get Medical report, they will get 221g, and they will be instructed to send passport and Medical report whenever it becomes available. They should get visa within a month after they submit missing documents.

Do not try to reschedule the interview, If you do that then it will be up the consular office when to give you a new interview date. Sometimes they take many months before they give you a new interview date.

FYI, 221g does not mean denial of visa, If may mean that they need to submit missing or additional documents.

      Thanks!

Thanks for the reply! I had heard some stories about green card applicants being sent back without interview, in the absence of the medical report (not necessarily in Mumbai consulate). I thought that perhaps the medical report is a special document in the eyes of consular officers. I am curious whether anyone has had this experience (either positive or negative) recently at Mumbai consulate with respect to the medical report?

        Outcome

Just wanted to let you know about the outcome of my parents' visit to Mumbai consulate. I struggled with whether to postpone their CP interview, or to go for it with a missing medical document. Well, we decided to go ahead with the interview anyway. But, they were sent back from the consulate's document collection counter, without an interview. Too bad.

Fortunately, the counter clerk told them that as soon as the medical documents are received from the clinic, they will get a letter from the consulate scheduling a new date. So, hopefully, the new date will not be too far into the future. Overall, I think going for the interview was the right call. Thanks again!
