  • I-765

    Hi All,
I have a question about form I-765 (Employment Authorization). Currently, I just got my authorization card through F1-OPT and its valid for a one year. I'm planning to apply for a family based green card now and I wondering if I have to fill out I-765 or should I just skip it and wait until I get my green card. I guess I confused what is purpose of this form? is this form is just gives you availability to work before you get your green card or is this form gives your ability to work after you get your GC?
    Thank you,
    V

Are you getting ready to submit I-130 and I-485 for Green Card status?

The Work Authorization is good for a year, so don't submit another I-765 unless you haven't gotten the Green Card before the Work AUthorization expires.

Once you have a Green Card, that card serves as authorization to work and the Work Authorization will no longer be needed.

yes, I'm going to submit I-130 and I-485. I just wasn't sure if I have to submit I-765 as well. Thank you for the clarification Ray B.

Normally, submission of a visa conversion package (I-485 and I-130) allows you to submit optional I-131 and I-765. Since you already have a Work Authorization with an expiration in the future, there's no point in asking for a second Work Authorization. Once you have the Green Card, a Work Authorization is not needed to legally work.
