  • not living together

    Hi,

thanks for checking in. I would like to take some advise regarding green card filing.

My wife applied for my green card few days back and the situation we have is "we are not living together yet (as in a same household)".

My wife is a US Citizen and I am working on H1B visa. I entered US as a student, completed my studies and received my H1b visa last year. My wife is having a full-time job and lives in NYC, where as I have to travel to other states depending upon contracts between my employer and their clients; to maintain a good employee-employer relationship required to maintain my H1b visa.

Before getting married, I and my wife were in a relationship for more than eight years and have more than 25,000 photos to prove that. Upon mutual understanding, we waited until she receives her citizenship to get married because of the different USCIS processing times for US Citizen Sponsor and Permanent Resident Sponsor. (probably that was a bad advise from someone, but who cares we both were students and unemployed)

Even if we are working apart and having different mailing addresses; we meet each other at least once in month. Either I travel to NYC, or she travels to Utah (my current client location). Also, we have documented all our travel itineraries from past six months (there will be more until they schedule an interview).

Common stuff - joint bank accounts, car insurance, etc we already have except joint apt. lease.

Any suggestions for improvements? Please provide your feedback, we will really appreciate it.

    Thanks,

Your actual Adjustment interview will be when "cohabitation" proof will be an issue. This won't be the first time this type of issue will have reared "its ugly head' to your interviewer, so his attitude will be "prove it to me."

Accumulate and package your proof of job-required separate address and travel, including affidavits, proof of being together when you are together, joint account and tax return documents. Take these to your Adjustment of Status interview.
