    Hello -

    I am an US Citizen and have filed for spouse visa for my wife who is in India. We have submitted our I-130 and waiting for the second stage with NVC.

    Our lawyer suggested that my wife get a new Indian passport which lists myself as the husband. Is this necessary?

    Also, my wife has not changed her lastname. We discussed doing it once she moved to US. Is performing the name change now necessary?

    Appreciate the feedback.

    Most passports, from countries other than India, do not have spouses name shown. There is no particular reason, in my opinion, for your wife, to change to report her marriage to your passport agency or to change the passport name to your family name.

    So long as you submit the petition paperwork in your wife's maiden name, and her passport remains in her maiden name, the U.S. consuate handling her visa processing will issue the visa i her maiden name.

        I agree with the previous answer. I've never heard of adding your spouses names to a passport. I would get a different lawyer.
