    I have being married for 3 months. My marriage has broken down and my husband is refusing to file for i-30. I have being encountering verbally abuse from my husband every since we got married. It is becoming impossible to carry on living this way as it is taking a toll on my mental health. I have moved out and is living with family. Would I be able to self petition, although I have not or never being given a conditional green card. Has anyone encountered such problems. He has not being physically violent. I have little evidence to prove and he consistently threatens me with divorce.

    Yes, you can self-petition for immigrant status, using form I-360. But if only married for 3 months, and with no police reports or medical reports of abuse, you aren't "bringing much to the table."

    If you are in the U.S. on a visitor visa (B2), you may have to consider returning to your home country if he divorces you.

      "Verbal abuse" alone during a cohabitation period of 3 months will be viewed with skepticism when self-petitioning.

      Police and hospital reports, or significant affidavits from witnesses are what will be needed.

      It's not reasonable to give false expectation to someone whose proof of marital relationship is as minimal as the original poster provided.
