  • I864 Joint Sponsor

    My Father is GC holder and has filed I130 for my sister (his daughter) who is under 21 yr age. Since he doesn't earn enough income, i filed I864 as a joint sponsor even-though my dad lives in the same house as me. only reason i filed I864 as a joint sponsor is because i file tax returns jointly with my husband. i work and make enough income ($50000/yr). my husband works as well, he filed I864A cause of joint tax returns.

    NVC sent an error first time under my I864 saying following
    In Part 6. Sponsor's Income and Employment, please correct the following...
    [x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal
    income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

    and for my husband I864A
    [x] ________________'s income indicated on line 11 of the I-864A does not
    correspond to that shown on the most recent tax return and W-2(s).

    SO my husband corrected the mistake and resent New forms with correction

    and just recently we got an email

    under my I864 saying following

    income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.
    and for my husband I864A
    x] ________________'s income indicated on line 11 of the I-864A does not correspond to that shown
    on the most recent tax return.

    and they also said
    "You should obtain these documents and forward them to the visa applicant so they may be presented at the final interview. The applicant must present all required forms and documents, including the missing items to the Consular officer at the visa interview" this indicate that she will be receiving visa call soon.

    so we are about to prepare new I864 but we want to make sure we do not do same mistakes again.
    what would you recommend to avoid error? because this time its very important.

    also she will be turning 21 in march 15 2014 so shoul my dad call NVC and notify them and ask them to expedite the visa interview process?

    your help will be greatly appreciated.

    The last letter you received ("checklist") indicated that they found your sponsorship documents "essentially" correct, but that some of the form edits did not pass. Within a couple of weeks, your sister should receive her Consulate appointment package (when a new group of dates are open and available), but your sister will be expected to take a corrected sponsorship package to the interview.

    Since it isn't clear to me, from your description, what errors are still outstanding, I would recommend that you have a third party, experienced, review your redo of the new I-864 and I-864A, and same supporting documents, before sending to your brother to take to his interview.

    For your information, this type of ongoing snafu is common with the new I-864 design, but the errors are generated by the barcoded checking of each submitted document, and NVC staff have no choice but to continue sending you these error packets, though they are now allowing the case to go to interview status.

      another question i have is my sister is turning 21 on 15th March 2014. Even though last email from NVC notified us that she should be receiving visa interview call soon, should we still go ahead and notify NVC and US consulate, Mumbai about it? What would you recommend? I am little worried abut it.

      could you advice?

        Which relative petitioned your sister? A parent?

        If so, then NVC should be notified that she is approaching 21 and you are concerned that she might "age out."

          yes Ray my father petitioned for my sister! ok great my father will call NVC on monday and will notify them.

          will it be a concern if she has an interview in january 2014 (her birthday is 15th march 2014) which less than 60 days before her 21st birthday?

          one more question Ray regarding I864! My dad live at the same house as me and i file I864 as joint sponsor and my husband I864A because we file income tax jointly? this should not be an issue right? because i have read that if the additional sponsor lives in the same household as the petitioner, he/she is considered a household member, and cannot fill out a separate I-864?

          i really appreciate your help!

            If your sister's (petitioned by he father) priority data is now available, finish the NVC requirements as fast as possible.

            It works better for you to do a separate I-864 as a 'co-sponsor,' with you husband using I-864A. It is not true that you have less change of a problem by using the I-864A because you share the same address as your dad. I-864A submittals have a higher rejection rate, whereas an I-864 "standalone" co-sponsor package is easier to review by NVC staff.

              Errors in I864 & I864A

              I have same problem as the problem is mentioned here. I submitted I864 and and I864A twice, but both times, I received same errors. However, the applicant is appointed for visa interview, but he has to submit correct version of I864 and I864A on the day of his interview. His interview date will be approaching soon, so if you find the way how to fix the problems, could you please tell me the solution? It will be highly appreciated. Thank you...

                If an interview date has been given, NVC staff know that the sponsorship requirements have been met. The problem, however, is that NVC thinks you did not complete the I-864 and I-864A forms correctly (did not pass the edits). Have a third party look at your documents and provide corrected ones for the beneficiary to take to the interview.
