  • Returning to USA with my Mexican Husband

    I am a US Citizen and I married my husband almost 3 years ago while I was living in Mexico. Since then I've pretty much been a house-wife and just helping with the family business so I've not earned an income. He has been offered a job in the USA and we really want to take it but I'm not sure what the fastest process is. If he comes with me to the USA on a tourist visa and we immediately file his paperwork (I-130 and I-485) about how long would it take for him to be able to work? Can I come to the USA first and start the paperwork before he gets here or would that require consular processing (which seems to take longer)? In Mexico we were living in the family house so there was no such thing as a lease or joint accounts so we will have to establish all of that when he arrives in the USA. Is that going to be a problem? Since I have no income (we want to start a family so I won't be getting a job) I know we have to have an additional sponsor which isn't a problem. I just don't know where to start to get him working as fast as possible and I don't want him to get into trouble for coming to the USA on a tourist visa when actually we're married. I would appreciate any feedback.

    Well there's a few ways to go with this. If he was offered a job than have the future employer apply for his work sponsor visa. You could always file your i130 with the nearest embassy to establish your family relationship. As far as the i864 well it doesn't matter if he was the bread earner than he can apply his income. Or you could come here first and file here and he will have to wait for the consular meeting.

      It normally takes about 2 months to get his work permit if all goes as far as your petitions are all filled out properly. I filed for my wife who was living in Mexico City along with my son who was born there as well and total time from start to finish was exactly 3.2 months for permanent residence. I filled it all out myself.
