  • Affidavit of support : Form 1099 of joint sponsor

If a sponsor that me and my husband are using as part of the adjustment of status documentation prefers not to file a form 1099 document alongside her section of the affidavit of support, Is that ok? She has provided us with a copy of her tax return and all other necessary information except the form 1099, will this be acceptable or does she have to file the form 1099 even if she is the joint sponsor with my husband on my behalf? And her income covers the 125% poverty guideline anyway.

If she won't include a copy of the 1099-MISC form with her tax return copy, her income source document will be absent and her tax return suspect.

As an alternative, get an IRS transcript of his 2012 tax return information, and this will include all needed information and be accepted even more preferably over the tax return and 1099-MISC copy.
