  • Please Help. Need help for Green Card for Wife

    I got a temporary green card for my wife when we first married 14 years ago. I took her to the USA and she did not want to stay so we moved to Thailand. Now we want to move back to the USA but we have not made the necessary amount of money ($29,437 per year) for the last 3 years. That amount of money just isn't needed to live in Thailand.

    So the situation is this. We have been married for 14 years. We have a 12 year old girl and a 13 year old boy. We do not make $29,437 per year What are our options?

    You have to petition her again as your spouse, using I-130 and $420 submittal fee. I'm assuming the two children have U.S. passports.

    If you don't have income to meet the household sponsorship requirements of about $29,000, you will need to find a co-sponsor.

      Yes both of the kids have US passports.

      I do not have anyone that can sponsor. My wife thinks that just because we have been married for 14 years that should be enough. Can anyone point me to information that can convince her that is not the case?

        Tell your wife that she needs an immigrant visa to reenter the U.S.

        The requirements for an immigrant visa can be found at: /usa-immigrant-visa-process/

        Go ahead and follow the instructions for submitting the I-130 for your wife. The submittal fee is $420.

        The problem you will encounter is after the petition is approved and it goes to the National Visa Center (NVC) for sponsorship processing. You will have to provide proof of income or liquid resource that meet the following requirements:


        The problem your wife is having with your explanation is that she is listening to other Filipinos, each of whom considers himself an immigration expert because cousin Jose got a visa to the U.S. in 1975. I don't know of any other nationality whose members have more "immigration experts" among relatives and neighbors than Filipinos (I'm married to one).
