  • What should be filed with I-130 ?

    I am the spouse of a US Citizen and upon planning to file for my Green Card (staying on a tourist visa), we have yet to find a definitive list on documents to file along with, or within a certain time frame, with the I-130.

    After researching several websites with details on many documents & forms, these seem to be the forms they all have in common -

    I-864 (Proof of Financial Support)
    (Along with corresponding documents proving employment)

    I-485 (Adjustment of Staus)
    (Along with fees totaling $1,070)

    G-325A (Biograpic Info)
    It is my understanding that this form is for both the US Citizen and Foreign Spouse to complete separately.

    I-693 (Medical Exam)

    I-765 (Employment Authorization)
    (Along with copy of passport and visa entry record)

    I-131 (Authorization to leave the US while applications are pending)
    This also includes a filing fee. But is the I-131 mandatory to file if travel outside the US is not intended?



    Other documents that also should be filed include Marriage Certificate, Birth Certificates, Passports, Proof of Joint Accounts and or Bills, Passport style photos of both people

    I have studied in the US and after going through the process of obtaining student visas, I know that documents have to be filed to the USCIS in exceptionally perfect order. We don't want delays or rejections because we didn't include a certain amount of photos, or copies, or missed a document because it was not listed somewhere. And most important, should all of these forms be sent in one package along with the I-130? Or is there a particular order of filing?

    We are aware that an attorney has the ability to make this process go smoother, but that is an immense fee we cannot justify if we are capable of carrying this out ourselves. Thank you in advance for providing any additional help, suggestions and experiences with this process!

    You are describing a conversion procedure during which the I-130 and I-485 should be submitted together, with separate fees of $420 and $1,070.

    There are no separate fees for the I-131 or I-765.

    Average attorney fees for this procedure will be $1,200 to $3,000, not necessarily overpriced, but not necessary, if you are careful or have someone with experience review all your documents before you submit.

        Which other forms? Everything is submitted together at the same time. This means original signature forms, copies of civil documents, two checks, etc.

          I cant locate a definitive answer on when these should be presented. We would hate to have the process impaired because something was missing or filed too late. Thank you for your help.

            Everything gets filed at the same time. But your package needs to be well-organized, with a cover letter.

            So the "definitive answer" is "together."

              Thank you for clearing that up. After combing through numerous web pages and 'step by steps', I couldn't come up with a complete list. Even USCIS directions are fuzzy. I have organized similar documents before for student visas, but no where near in depth as these applications. They are not forgiving.

                That's a good description of the process, especially since it's on an immigration attorney's site. Most immigration attorneys are reluctant to provide too much detailed information, as that increase the likelihood that the applicant realizes he won't need legal services.

                  What should be filed with I-130 ?

                  Hello. I filed for my wife and son on August 29 2013. My wife is from Mexico City and my son was born there as well. September 6 th 2013 received all the texts of receipts from USCIS.

                  my wife did her biometrics on November 4 th 2013 in M***aukee Wi and we received her EAD along with travel parole on November 12 2013. The same with my son's travel parole.

                  AOS interview in M***aukee Wi USCIS on December 5 2013 for both and approval at the end of the interview.

                  Since my mortgage and utilities bills were already established before I got married I couldn't follow the typical submittal of documents of joint bank accounts- credit cards bills in both names or both names on leases or checking in both names or utilities or anything like that but I did send copies of all our dentist bills -- doctors bills. Medical Insurance statements. Letters from our family doctors for both of us along with my sons pedia doctor. Pictures of us since they came to the US. I even sent copies of the prescription bags that you get from walgreens because they show names dates and addresses. The more important message that I felt was important to the USCIS was showing a time line of names and dates and addresses along with the fact that I supported them 100%.

                  I also submitted all the tax info W-2s - payroll stubs etc etc etc.

                  When I sent all the forms and supporting evidence in a shoe box it weighed 3.5 lbs. I filled and filed all the paper work myself. Error free but I had gone over my finished petitions 5 times with a fine tooth comb before I sent them. No attorney or immigration business service.

                  Sure I can share a little. But hopefully you filled your petitions all correctly and the only reason I say that is cuz every form has it unique instructions on how to answer a question even if it doesn't apply to you. Like N/A or leave it blank stuff like that. Computer scanning does the petitions and uploads the answers but if certain areas are left out it may mark it incomplete

                    I have downloaded all of the forms and skimmed over them, but we have not started filling them out as of yet. We are waiting to get our official marriage certificate back from home. The process seems relatively straight forward, assuming of course that everything is completed as needed. Once we start filling everything out, I may message you with some questions if that's ok?

                    My husband and I began dating about 7 years ago. There was a lot of flying back and forth, but I don't have some of the documents that some of you might have (insurance, doctors, etc.) We have an apartment lease in both our names, and will change bank accounts to be accessible by both of us. Utility bills will also be changed over. That is all the extra documentation we will have for the most part, seeing that we have only been married for a few months now. I plan on submitting this evidence, along with lots of photos, to help support our case. I can maybe dig up old boarding passes/ticket info to show that we did travel to see each other for several years. Are there any other recommendations?

                        I AM A GREEN HOLDER AND I HAVE APPLIED SPOUSE VISA FOR MY WIFE AND MY PETITION GOT APPROVED ON 12/13/13 AND OUR APPLICATION HAS BEEN FORWARDED TO THE NVC.
                        CAN ANY ONE TELL ME WHEN WILL SHE BE SCHEDULED FOR HER INTERVIEW?
