  • I-130, Question 14

    Hi All,

I need some help with Question 14B on the I-130 Form.

I got married to a US citizen and got my greencard but I got divorced before the two year condition. I still filed for the removal of condition and was able to prove that my marriage was a legitimate marriage and I didn't marry just for a Greencard. I have had my Greencard for 5 years now and I just filed for my US Citizenship.

I'm getting re-married now and filing a petition for my wife. In question 14B, will my answer be a "yes" or a "no"? Will I say that I gained Permanent Residense through marriage to a US Citizen?

I'll appreciate if someone can spare a minute to answer my question.

    Thanks a lot.

You must answer "yes" to that question.

Thanks a lot Ray. I agree with you but will I also need to provide the supporting documents for proving the legitimacy of my previous marriage? When I proved once that my marriage was legitimate and got a greencard, I don't think I'll ned to resend any evidence again. Please advise. Thanks in advance.

The legitimacy of the marriage that facilitated your Green Card is not an issue right now. The #14 question is asked to eliminate those whose prior "Green Card-enabling" marriages were less than 5 years previous.

That's not to say that it won't come up in the future...more likely during the Naturalization interview, as that event gives USCIS reviewers an opportunity to check all your previous immigration procedures.
