  • Greencard for brother

I am US citizen since 2008, I want to file green card for my brother who is married and above 21 years of age.
I read the instructions on USCIS website about it; however, it wasn't very clear to me on how to file for his greencard. Where should I start? Should I go through an attorney? Would he be able to come on a non immigrant visa while his petition is pending? Please advise.

You can submit an immigrant petition, I-130, for your brother, but it will take 12-23 years (depending on his country) before he is eligible for a visa. You don't need an attorney to complete the two-page I-130 and attach proof of your citizenship and relationship. Your brother can apply for a visitor visa, but he won't be allowed to stay in the U.S. the entire period while waiting for an available visa slot.
