    Hi all
    My case complete at NVC under f2a on 27 jan 2014.
    For my wife and 4 months old baby. Waiting for IL .

    Another side my citizenship interview got done in dec 2013 approved.
    Waiting for oath letter. Hopefully get oath for March 2014.

    Question : if case left from NVC and interview scheduled for april 2014
    And I get oath ceremony for March, still I have to call NVC let them know
    About my citizenship , if yes should I have to file separate i130 for my son? which can delay the process.
    Where interview date will already be initiated.

    As a derivative visa holder under your wife's eligibility, an available visa slot (F2A) has been used to process your child's visa.

    If you were to inform the NVC of your citizenship status, your child would become "immediate priority, CR-2 or IR-2," which means a visa slot is "immediately available." But since the case has now been forwarded to the appropriate Embassy, the NVC would only advise you to submit another petition for the child.

    There is no difference in child's status, except that a new petition would have to be submitted for the child for him to avail himself of "immediate priority" in exchange for "available visa quota slot."

    My advice is to proceed with existing F2A processing for the child, grandfather established priority, BUT SUBMIT AN I-130 FOR THE CHILD IMMEDIATELY. to demonstrate intent to take advantage of "immediate priority" visa status. If at the Embassy interview for F2A approval, and your completed Naturalization come up, provide proof that a new I-130 has been submitted for the child. The Embassy reviewer could then go either way, but would have no reason to deny the F2A for inappropriate intent, since a new I-130 will already be in the works.
