Both my Parent's I130 denied. Please Help me

Hi All,

My both parent's I130 got denied because of my birth certificate was issues on later date after 21 years.

They asked for other evidence and I submitted it but some how USCIS did not like this.

These are things I submitted.

1) Old Passports(three) having parent's name: Issued after 21 year's my birth date so not accepted.
2) Marriage certificate having parent's name: Issued after 21 year's my birth date so not accepted.
3) School certificate : It is issued at school but that is the only one evidence so we need more.

Help me what should I do before 6th march as I got a NOTICE OF APPEAL has to be received by UACIS by March 6th 2014.

Please help me what ever way you can to achieve this thing.

What ever document I need to submit and how the APPEAL process works.

Seeanj1,

The reason for the Request for Evidence, and or/denial was not clearly stated by you. If your birth certificate shows parents names, other proof of relationship should have fallen right in place, or you should have been requested to do DNA testing.

Did USCIS suggest DNA testing as an alternative to other written evidence?

Hi Ray,

Actually my Birth Certificate was issueed on 2001 and my birthdate is on 1973.

According to the USCIS because your birth crtificate was issued after 21 years and it is not original that will not proof that they ware your original parents may be they are adopted parents to you.

After that I submitted secondary evidence like my passport, my marriage certificate and my high school certificate but USCIS is saying those are also issued on later date and may not accepted except my high school certificate. They want more evidence.

Now it looks like I may need to do these following things for my Birth Certificate.

1) Birth Affidavit Father
2) Birth Affidavit Mother
3) Birth Affidavit Uncle

I donot know whether I need DNA test now or not.

NOTE: I have a quick question do I need to have NON AVAILABLE CERTIFCATE for me. As I my Birth certificate was issued later date and I do not think they will give me NAC at municipality. Can you please help me what should I do.
