Hi.
I am currently on H4. My husband might become eligible for GC processing under EB1 category. But that is still under internal eligibility check at his company and might take another month or so (late March or early April)
In the mean time, I do not want to miss chance of getting work permit, so will be applying for H1B through a consultant.
In this case, I have following queries:
1. If my H1B gets approved, can I still include myself as dependent in my husbands GC application
2. If EB1 process starts before H1B decision is received, then I will file my status as H4. If later on H1B is approved, will the GC process get affected due to this?
3. If I start working on H1B from Oct, and received GC after that, will I need to do some adjustment of status again, as my status during GC filling would be H4 but later on will become H1B?
Is there similar thread already existing, where I can get more information on this? Is there an attorney or immigration authority who can put some light on this?
