    Hi,

    I'm applying for my mother's green card. I am a US citizen, 22 years old. I live outside the States (Honduras). I didn't go to school in the US and never worked there before. I have a valid drivers license from Florida and I also have a bank account. My question is, Is this a problem when i submit the application? Do i need to show proof of residency when applying? My aunt, who has lived in the states for over 20 years will be my moms sponsor (She pays taxes and has had a steady job for a long time).

    You can petition your mom while you are outside the U.S., but you must have a U.S. address, and must express intention to return to the U.S. before or at the same time as your mom coming to the U.S. In other words, a U.S. domicile is required of petitioners.

      Hi Ray,

      I'm starting the process of applying to different schools for my majors degree. would that work? Also, about the address from the states, i dont have to say i live there right? I dont need a letter saying im paying rent for an apartment or something like that? I dont want to lie in my application. i just feel unsure on what to do.

        You should provide a U.S. address at which you can receive mail. Once the petition reaches the interview stage, you must be prepared to prove that you have a valid 'domicile' in the U.S. If pressed for proof of this, you must demonstrate that you already have that U.S. domicile or will be returning to the U.S. with your spouse and have a destination.

        This comes up fairly regularly with U.S. expats whom I assist and who are living in the Philippines or Thailand. Sometimes the Embassy gets very aggressive for proof of the U.S. domicile while other times the reviewer just assumes the petitioner is going back and forth, but will be in the U.S. (or go with her).

          Hi Ray, When exactly is the interview stage? I have only sent the petition request and the sent me a letter asking to confirm the name of my mom. I want to know so that i can get ready to move back to the US. Thanks

            If you are talking about petitioning your mom for an immigrant visa to come to the U.S., the only interview is for her visa at the appropriate Embassy, after which the visa is issued and delivered to her.
