Hi all, i hope someone can help me.
My husband and I have been married since Aug 2011 and I've been with him since highschool pretty much. (btw im 29) I got approved for my CR1 visa May 2012, we have a one child born in the USA Oct 2011.
On June 2012 after I got approved for CR1, my daughter and I to Canada to visit my family for the summer and Husband came as afterwards for the summer.
With marriage complications rising, by Aug 2011, my husband stoled my daughters passport and as a homemaker I stayed with my child in Canada and as we tried to solve our marriage issues.
When we were finally ready to return back to the US, Jan 2013, my husband again left us but this time disappeared and went off and traveled the world pretty much (8 different countries) and I started to establish my life without him so I can move back and officially seperate from him.
Summer of 2013 I tried to move back to the US, packed my things to storage until I could officially settle down with my toddler. So I traveled back and forth from Canada to US but spent most of my time in Canada with the abuse and threats from my husband increase as he found out I was planning to move to the US.
Pretty much to sum it all up now, he married another women in an islamic marriage, took her to the USA and is fighting me in court. And doing whatever possible to not allow me to renew my GC. I am going through alot of hardship, stress, pshychological abuse but I am currently still in Canada, but I want to move and reside in the US.
I managed to get a an apartment for my daughter and I end of 2013, but with the complications with this man it has made it difficult for me to live in peace from him. He won't give me my divorce and fighting me for custody for our child.
IS THERE a way I can apply to extent it while i transition from Canada to the USA, and try to resolve my life as I move far away from this man to another state b/c he is making it difficult for me to live in the same state as him.
I'm not sure what to do with my CR1 expires end of May, I am trying to go back before the expiration date but with all the issues I'm not sure if I can......
I know i want to get an immigration lawyer, but I just don't know of my odds in all this process...
I know it's a long message, but if anyone has any advice it would be greately appreciated.
