  • Family sponsored immigration F2B

I have a couple of questions on immigration of type F2B under Family-sponsored. My father had filed the immigrant visa for my brother and me. I am starting to plan for my marriage and my brother is already married due to the very long waiting time.

    1. If I am going to marry before I migrate to the US (NVC is already asking for AOS fee), can I still proceed with the immigration process to the USA?
    Is the case still valid?
    a. If yes, how would I apply the immigrant visa for my future wife? Will she be eligible under the same case?
    b. If no, is there any other way that I could arrange for this?
    c. What will happen if we get married after I get the immigrant visa?

    2. Due to the long waiting time, if my brother have already married few years ago but few years after the petition is made, is the case still valid? Is there anyway around for him if it is not valid?

    Thanks very much,
    Stephen

    1. If you marry before entering US, you will NOT be eligible for VISA or your visa may be cancelled if USCIS found out that you got married before entering US. You can marry after getting GC ie after entering US.
1b&c. Once you have the GC, you can apply for your wife under F2A.

    2. If he is married his petition will be revoked. There is no way around it unless your father is US citizen.
