  • How to Bring Child Under 2 years born outside US

    HI,

Iam a green holder for last 6 years and filed green card for my wife 3 years ago.

We had a daughter a year ago, while my wife's green card in process and now my wife got a visa appointment for consular process in India.

Should my wife take my daughter also to the consulate to bring my daughter to US along with her.

Os as my daughter is under 2 years, can my wife(after my wife's visa is granted) bring my daughter directly to US without any Visa.

    Please let me know.

    Thanks
    Bharath

The child will need a K2 derivative visa, and this will require a medical exam, visa payment of $240 and the child must be at the interview with her mother.

My Wife is not a K1 Visa Holder. She will get her Immigrant Visa. Can she bring her 1 Year Old Baby with her without any special visa for the Baby

I'm sorry, I misinterpreted your earlier message.

Since you are a Green Card petitioner, your wife is a quota-based visa applicant, and your child is eligible for a derivative visa. The child will need to be processed for an immigrant visa, just like your wife Since you may not have reported the child's birth to the National Visa Center, you will now have to report the child's birth and claim eligibility for a derivative visa. Your wife is the primary beneficiary for an F2A visa.

You or your wife should contact the Embassy (or Consulate) where your wife will be processed and ask for the child to be added as a derivative visa applicant under your wife's "primary" status. You will need a passport for the child, will have to pay the $230 visa fee for the child, and the child will need an immigran immigrant medical exam.
