    Hello,

    I filed I-130 for my sister on Feb 25th, 2013. At that time she was single and now she is married as of July,2013. I am trying to get an answer regarding what I have to do to have my brother-in-law added to the petition. Do I have to submit another I-130 for him or can his name just be added on using a separate form or a letter? Please assist me in figuring out this matter. Thank you for everyone's help in advance.

    Wait until the petition has been approved by USCIS and been forwarded to the National Visa Center. Even though you will have a several-years wait before a quota visa slot is available at the National Visa Center, you can still report the marriage if you have the NVC-assigned case number. You should then send a copy of the marriage certificate to the NVC, providing case number, names and birthdates of petitioner and sister. Having the husband's info added to the case will insure that he has derivative visa status once your sister's visa slot is available. A separate I-130 is not needed for the husband.
