H1-B applying for GC after marriage to US-born citizen - need help w/ form selections

  • H1-B applying for GC after marriage to US-born citizen - need help w/ form selections

    I would like to petition for my wife to get her green card, however I am confused on which forms we need to fill out and send in.

    Our particulars are:
    Petitioner (me) – born & raised in the US
    Applicant (wife) – born & raised in INDIA, came to US as a student to complete grad school in 2008, currently employed with H1-B visa with a US company (full-time resident) and has applied for Greencard through company and is in the (long) queue.

    We have an international trip planned August 30, 2014.
    We have been married since August 2013.

    My plan is to concurrently file I-130 & I-485.

    Do we need to include the following while submitting the above forms, or will we be asked to submit them later? Are all of the following required…I read through a lot and got fairly confused, since she's already employed w/ H1-B
    1. G-325A – Bio Information
    2. I-693 – Medical Info
    3. I-864 – she’s working and supported herself for years…do I need to submit an Affidavit of Support?
    4. I-765 – only if she wants to leave her current job PRIOR to GC approval, correct? Then she could apply for a new job without needing to be sponsored as an H1-B?
    5. I-131 – concerned with our international trip (or can she still travel on the H1-B if she stays at her current employer)

    Submit everything together, at the same time, except for I-765 if her current Work Authorization is good for at least another full year.

    The only time USCIS asks for something later is if your submitted package didn't include all the needed documents and evidence.

      Thanks for the reply! We're in processes of filling out the forms now.

      Do we need to submit a I-131 if her current H1-B is good until Sept 2015 (17 months from now)? She should be able to re-enter the USA using that visa, correct? Or does something happen upon applying for Greencard?

        Include the I-131 and I-765.
