  • Sponsoring married siblings together.

    Hi,

I am US citizen since 2008. I would like to sponsor my siblings (2 brother and a sister) who are all in late 30s and 40s. I have gone through many of these threads but still not sure -

    1. If I can apply for all siblings all together or it should be separate for each one.

    2. How about their spouses and kids (under and above 21 years).

    Thanks in advance.

You need to file a separate i-130 for each sibling. Once they get their green card they can file for their families. I have filed it for my brother in 2011 and still have not heard anything from the immigration... My other brother and his wife went and got a tourist visa in a week. Go figure...

Note: A separate form must be filed for each eligible relative. USCIS processes Form I-130, Petition for Alien Relative, as a visa number becomes available. Filing and approval of an I-130 is only the first step in helping a relative immigrate to the United States. Eligible family members must wait until there is a visa number available before they can apply for an immigrant visa or adjustment of status to a lawful permanent resident.

Depending on the country of your siblings, the waiting period for available visa slots will be 13 to 23 years. Spouses will be eligible for derivative visas, but children must be less than age 21 to be eligible for derivative visas.
