    Hi,

    I have filed I-130 for my brother who is in Russia in 2011 and have not seen any traction on the status since then. My parents got their green card here in US in 3 month. My question is - can my parents also file an I-130 for my brother to bump up his priority from F4 to F2B or do I need to withdraw my I-130 first? Will this even work?

    Your parent (either one) can petition their son (your brother) without your having to cancel your existing petition.

    It would be better if the child petition be from mother, rather than dad, as there is a higher incidence of DNA testing requests for Father/son petitions.

    If your brother is or becomes married, parent's petition will be invalid, so long as they are Green Card holders.
