waiver of in admissibility

After interview for AOS family based petition, INS officer is asking for i601 to prove extreme hardship for a criminal record of having less than 30 grams of **** back in July 1999. Couldn't it be filed purely on it happening 15 years ago rather than extreme hardship if we file in July of this year?
