    me and my wife file tax return separatly. my mother in law ,green card holder,filed i-130 for her two kids under 21 . now she needs affidavit of suupport
    my question is can i and my wife jointly jointly be as joint sponsor knowing we don t qualify unless both our income are combined.we don t qualify either for two joint sponsor for each of the kids separtely. my mother in law less than year here ,0000 income,,didn t file tax

    If you and your wife file tax returns as "single" or "head of household," rather than "married/separate," you are presumed to be living separately and cannot combine your incomes for sponsorship purposes.

    If you and your wife file as "married/separate," (the correct way if living together), you combine your incomes, using the I-864 and I-864A to constitute a single co-sponsor entity.
