  • What is priority date?

    What is priority date?
Is it means the date when anyone apply for his/her relative?

How long time it take to bring immediate relative ( father, mother or children) in usa?

Priority date is the date that USCIS officially opens a file (after receiving your paperwork).

If the petitioner is a U.S. citizen, timeframes for parents and children under 21 are 8-12 months.

      I have several questions :

      1. My sister is a us citizen. She will apply for my mom within 1 month . Can my mom go to USA within1 year?

      2. I heard that it takes 4 weeks to get a green card who recently entered in the USA with an immigrant visa.
After reaching USA can my mom apply for me immediately under F2A category?
Now I am 18 years of old.

      3. Is there any possibility for me to go in the USA before 21 years of age?
Otherwise it will turn into F2B category.

      Thank you "Ray B"

When a Priority Date doesn't move for a while, it's because that class is "over-subscribed," or slots are being "borrowed" to be used for something else. Sometimes when a Priority Date is announced as current, the State Department backs up and "retrogresses" for another 1-3 years.

            1. One cannot predict whether mom will be here with a visa in a year. 10 months is about average, but if anything is wrong with papework or evidence, or if mom is from a country that requires extra scrutiny of visa applicants (Afghanistan, Pakistan, Iran), processing time can go beyond standard averages.

            2. The Green Card may now take 1 - 6 months, since the new Green Card fee ($165) has to be paid and processed before the Green Card is generated.

            3. Once in he U.S., your mom can immediately petition her eligible relatives, since she will have an I-551 annotation in her passport.

            4. Which retrogression period are you referencing? If your sister is a U.S. citizen, she can immediately petition mom, and there are no retrogression issues.

In IR-5 parents visa my mother's petition approved. NVC send an email to my sister who applied for my mother.

In this email NVC gives some instructions.
                They said :-

"" Children who pass 21 years of age after the petition was originally* approved* become intelligible to accompany or join with the original petition """

                My question is ---
                1. ""Can I go with my mother?
2.If not then "Can my sister adjust my petition?

N.B: - My sister applied for me in the F4 category and my current age is 19 year 3 months
