  • F2A visa issued: How does retrogression affect?

    Hi,

    I recently received my F2A immigration visa but haven't immigrated to the US yet. With retrogression happening right now (and my PD not being current anymore), two questions came to my mind:

    1. Does retrogression affect me after the visa was issued or does it loose it's influence?
    2. Is it a problem if I travel to US just a few weeks before my visa expires (3-4 weeks before most likely) - and retrogression took place?

    Once your visa has been issued, subsequent retrogression of the visa class should not affect you. My advice, however, is to use the visa much sooner than 3 weeks before it expires.

      Hi Ray,

      thanks for your answer. Why do you think I should definitely immigrate sooner?

        Because it is the "nature of things" that if you go to the end of the visa expiration, there is too great a likelihood that something will come up to delay you further.

        It has been my experience that after all the preparations for an immigrant visa, one should be prepared to use it before some cat*****phic event occurs to change your plans.

          Ray, thanks for the answer. I understand your concern and will immigrate as soon as possible. However, it can't be much earlier than this.
          Just want to make sure, that there's no legal immigration problem based on the retrogression or the shortness to the expiration date. Can you confirm that?

            Offshore,

            Once the visa was issued, you are presumed to have satisfied the Embassy staff that your Priority Date was reachable, and issuance of the visa is the concluding step in their involvement. A subsequent retrogression of reachable Priority Dates for your class should not affect an issued visa, as there are no addtional reviews of your Priority Dates currency.
