  • Affidavit of Support- i-864

    I am applying for a green card through family, my husband. Unfortunately, my husband does not meet the requirements to be the sponsor. I asked his mother to do it and she is going to be the joint sponsor. I have several questions:

    1) Is my husband still in need of filling a 1-864? If so, what does he need to check in part 1: Affidavit of Support Under Section 213A of the Act Part 1. Basis For Filing Affidavit of Support? How about his mother? one joint sponsor? or one of the two joint sponsors?

    2) what are other things I need to check if my husband is not able to meet the requirements but my mother-in-law does?

    As your petitioner, your husband must provide an I-864 with his tax return, W2 and employment verification documents. If his income is insufficient to meet the sponsorship requirements, his mom can provide her own I-864 package with same supporting documents, plus proof of her legal U.S. status.

      My question is super technical and I am stuck :/ Does my husband check "I am the petitioner. I filed or am filing for the immigration of my relative" box? Does my mother-in-law check box: only 1 joint sponsor? or one of two joint sponsors?

        Not exactly "super technical," but here is the answer:

        Your husband checks "I am the petitioner."
        Your mother-in-law checks, "I am the only joint sponsor."

          Where to file i-864

          Sorry to bother you again.

          As of May 15th 2014, where do I file i-864? Do I have to include OF-230?

            There is no OF-230 or DS-230 in use anymore. If you are being Adjusted in the U.S., your husband will be using forms I-485 and I-130.

            If you are being processed abroad, after submittal of an I-130, you will have to complete an online form, DS-260, after the NVC fee of $230 (for immigrant visa) is paid.
