  • a few questions

    Hi all,

I have a few questions... I am the beneficiary and my husband is a US citizen. We got married a few months ago here in Canada after being together for almost 9 years. We both live in Canada right now (border of BC).

We are about to submit the I-130 form. With the I130, we need to submit form G-325A. One for me and one for my husband. Its a silly question, but who needs to sign my G-325A? I would think it would be me, but it says "Applicant's Signature" and He is the applicant, not me. So I just want to make sure, we don't send the paperwork with the wrong signature.

Also, Can somebody explains a little how the process works? I've been reading up on this for months and it's a bit confusing when you get a bit of answers here and there... I have a few questions too:

    - we are submitting the following forms: I-130, (2x) G-325A, G-1145. Are there any other forms needed right now?
    - What happens once they have received the forms?
    - average wait times?
    - next steps?

Thanks you, I really appreciate you guys help

    Ellejee,

You sign your G-325A and your husband signs his G-325A.

You've listed the correct forms, but you must also include the $420 fee, one passport-style photo each, copies of birth and marriage certs, and some relationship proof (proof of commingling business affairs, living together).

Thank you. Would there be a problem if my husband is not in the US?

Your husband must have a U.S. domicle or have proof of returning to the U.S. with you after you have your visa.

Well, what we were thinking was wait for me to get approved and then go right away to the US. Is this possible?

Yes, that will meet the requirements, so long as he can provide proof of sponsorship ability.

Great thank you. Do you know the average wait once you've sent the first package (with the I-130 form)?

I-130 procedures for processing of the visa abroad are running 6-10 months.

Wow, that's pretty quick.. Thank you for your help Rayb, wish I could virtually send you a cup of coffee

After I send in the I-130, what visa would I get? and where does the affidavit of support comes into place? I thought we would need to provide the affidavit before I get a visa, or even get approved...

just saw that you had mentioned that I needed to include copies of birth and marriage certificate. I have included a copy of our marriage certificate and a copy of his current valid US passport. Do I need to include something else for him? Also, do I need to include my birth certificate or a copy a my current valid passport, or is it just for him?

The I-130 (for a spouse of a U.S. citizen) provides a CR-1 or IR-1 spousal visa (depending on length of marriage).

The Affidavit of Support and sponsorship documents are submitted during the second step, to the National Visa Center, after the petition is approved by USCIS.
