I-130 processing time is outside of the normal processing time !CSPA act AGE OUT !
Hello people;
I would like to thank you everyone in advance for your help. So here is the situation. My mother who is a permanent resident (green card holder) filed I-130 for my sister who was 19 years old in May 2012. The file was approved by USCIS in November 2013 and sent to NVC. In January we received a letter from NVC stating that they believed that my sister is already a permanent resident so they sent the file back to USCIS for further review.However this is not the case. My sister is not permanent resident. Ever since then I have been following up with USCIS and they say that unfortunately this file is under review and they can not give me a time frame for this case. When I check status of the case on USCIS site it still shows me the old status saying the file was sent to NVC in November 2012. My sister will be turning 21 in November so do you know if CSPA act protects her from AGE OUT ! Can you please tell me how can i find it out ? Do we need to file any form for this ?I really appreciate all your answers !
