    hello, all.

    I am trying to find out an important question about sponsoring my MARRIED brother to the US.

    me: I am a US citizen.

    brother info: he is over 21 & he is married.

    my question is simple: when I sponsor him over, will his wife be able to come as well with him (at the same time) -- (once the visa is approved)?

    yes, I know about the long wait time, which is not my question. I just want to know if his wife (and children) will be able to immigrate with him to the US (once approved) at the same time.

    The answer is "yes." Quota-wait family-based visa procedures allow for eligible family members (spouse, children under 21) to be eligible for derivative visas if accompanying or following primary applicant.

      Hi Ray,

      How about excluding the brother's 'wife'? Or she is automatically included as 'derivatives'?

      My brother and his wife are not in good terms right now because he found out that she's been cheating for the last 3 years.

        The brother's wife and children have to be listed on the petition, but are automatically excluded if no documentation is provided to the National Visa Center after the petition is approved, or if the petitioner or the brother advise the National Visa Center that the wife will not be applying for a visa.
