  • September 2013 priority date

    Hi everyone.
I an new here to the forum and have some questions and probably share many of your frustrations as well.

I am a norwegian citizen and married to an American citizen. We filed the I-130 papers after our marriage in August 2013. Our priority date was put to September 2013, but nothing was really sent our from the USCIS until march I think, due to them being so backed up on paperwork. We got a case # at the NVC in May 2014 and filed the DS 260 May 17 2014. After that the NVC needed some original (!) documents and everything was received June 3rd 2014.

    My questions are
    1. what does that priority date even mean?
    2. Has anyone else been waiting for this long?
    3. How long does it usually take for the NVC to schedule an interview after they have received all the papers? Will it be 30 business days or more/less?

Thanks to anyone that can answer some of these questions!

Hang on, you should be receiving Interview letter shortly.

      1. In your case, the "Priority Date" has no "bankable" meaning, since your processing is considered 'Immediate Priority," having been petitioned by a U.S. citizen.
      2. Your waiting time thus far is fairly typical. In the last 18 months there have been sporadic periods of fast processing by USCIS (1-3 months), but 6 months has been an average time for USCIS petition processing.
      3. Once the NVC is "satisfied" with your DS-260, sponsorship and civil documents, it takes about 30 days for an appointment package to be generated, depending on availability of interview dates for your home country U.S. Consulate or Embassy.

We received an email from the NVC on Friday stating that they are missing documents.
It does not specify what, just that they need something from me. I have confirmation from USPS that all my original documents were received June 30th (took 1 month to get there from Norway for some odd reason!!!) and they got other documents they needed from our lawyer June 3rd.. Does this mean they will need another 30 business days to process it all if they indeed have all the documents? They just haven't connected the two envelopes to our current case..? I have no idea what other original documents they will need at the NVC.

Waiting even longer is incredibly frustrating!

NVC notice of "missing documents" are routinely sent out in error when one of three submittals are reviewed (sponsorship, civil documents, DS-260), and the reviewer is not aware that the other submittal(s) have been received. The most common instance of this is after a DS-260 has been received, a "single work station" assumption is made that the civil documents have not shown, when that submittal may be sitting on "another desk,"

If you are confident that all the known submittal requirements have been met, it is best to avoid "calling out the Marines," but to instead wait a couple of weeks, then check with the NVC by phone, and/or just wait until you receive a "completion" email from the NVC.

So we will eventually get an email that states everything is completed..?
Our lawyer was confused by the email as well and will be trying to get ahold of them just to make sure everything is there. Don't want to wait long than we have to now

              Thanks Ray B
