  • Question About Affidavit of Support

    Hi I applied for my wife and three children and did the affidavit of support. One of my daughters has since decided that she doesn't want to come to America anymore since is getting married soon.

    What do I have to resubmit and how long will my application now take to be processed?

    You don't have to change anything. Were you a Green Card petitioner or U.S. citizen petitioner? If the latter (U.S. citizen), you needed to submit separate I-130 petitions for wife and children. If a Green Card petitioner, the children, under 21, were included with derivative visa eligibility. In either case, a child can drop out of the eligible group by simply not continuing with her processing.

      I am a green card petitioner. So the applications for the rest of my family wont be affected?

      By the way she is really my step daughter so her eligibility is actually based on her mother's eligibility.

        When completing the forms for the National Visa Center (I-864, DS-260), just leave the child off. This is fairly common when one of the derivative family members decides not to continue with process, marries, ages out, etc.

            So there was a little mix up and my wife submitted the DS260 for the child that is getting married. Will this cause any problems?

              It doesn't matter if a DS-260 has been completed for a family member who is not immigrating, Whoever gets an interview date, a medical exam and shows up for the Consulate interview, will be processed for a visa.
