I legally reside and work in the USA under a H1B visa. My employer is offering to sponsor my green card application. I have a 17 year old son. I know that I can request a green card for him in the final stage of the process. As my application would be filed under EB3 and given the priority date for my country, he may make it just in time - or not.
Now I am in a relationship with a US citizen, which is getting quite serious, lucky me We have started talking about marriage - which opens a second (and faster) route to permanent residency. If I were to take that path, can I request a green card for my son just like in the employment based process? Or, would I have to wait until the probation period is over?
