  • Need help understanding sponsorship process

Hello I am a Canadian citizen and my wife is an American citizen, we have a marriage certificate approved by the Canadian government. I would like to know that if I am planing to get my wife to file a petition for me in the Untied States, would I need to live in the US to get my green card?? Or can the process continue while I am here in Canada? I plan to work in USA when I get my green card but I don't want to move there and be unable to do anything because I don't have a green card. Thanks for the help in advance.

Your wife can submit an I-130 petition for you and you can be processed Canada for your immigrant visa. After your immigrant visa is issued, you come to the U.S. and your Green Card will be mailed to your U.S. address after you pay the $165 Green Card issuance fee.

Thank you so much Ray. I was just wondering if it would be possible for me to work with my immigrant visa in the USA? Also after I come in and pay my fees, can I leave the states and travel back to Canada for some time? Thanks for your help, much appreciated.

After an immigrant visa has been issued (IR-1), and you are arrived in the U.S., there will be an I-551 stamp in your passport which provides one-year Green Card status (pending receipt of the Green Card). The I-551 stamp and/or the Green Card allows work in the U.S.

Once one has the Green Card, you can stay outside of the U.S. for up to a year without a Reentry Permit, and up to two years with a Reentry Permit (separate fee).
