  • I naturalized after I sent I-130 .. Do I keep priority date ?

    Hello there .. I'm hoping if someone have an answer to this question or if my story applies to what happened with you.,

    I filed I-130 to my wife who is NOT in the US and on 6/13 I became a citizen and notified USCIS and Vermont's service center on the same date.
    now am I eligible to keep 3/3/2013 as my priority date or is it now 6/13.
    I've been reading different answers all over the internet.

    Also does anyone know of a reliable legal resource of this kind of materials so I can fight with USCIS with it ?

    Once you have received notice that you have been naturalized and that your petition status should be changed to "CR-1" or "IR-1," depending on length of marriage, your wife's status become "Immediate Priority," and the Priority Date originally assigned should be considered "Immediate Priority."

    It's kind of a moot question, since how you proceed depends on where the case now resides, USCIS or NVC. Has the original petition been approved and moved to the NVC?

      Thanks Rayb for response

      The case is still in the initial review at USCIS (not approved yet) .. The processing time posted on 8/7 is 5 months for a Citizen applying for a spouse.
