What is the best way to get GC for my son, first son is US citizen?

  • What is the best way to get GC for my son, first son is US citizen?

    My elder son was born in US and is now 13 years old. Younger one is one year old, born in India. We are currently in India. I would like my younger one also to have GC/ USC .

    We (parents) are Indian citizens and wish to remain so, unless necessary for my younger one to get a GC. Also we would like for both of our sons to finish graduation in India and go to USA for post graduation.

    to my knowledge there are 3 options.

    1. Elder sibling sponsoring younger one..

    . Assuming elder one goes to US after his graduation, he will do his post graduation there. IF he takes loan for that , would it be difficult to process GC for younger one because of the finance? Will he able to process GC only after he starts working?

    2. Elder sibling processing GC for parents and we process for the younger one.

    a. In that case only one of us would be able to go since the younger one will not have visa
    b. Not sure about the time taken.

    3. Parents go on work visa now, and then apply for a green card.

    Education of the kids in India would not be possible


    Which would be a good option? The aim is to get a GC for younger one by the time he is 21.

    The petitioner must be age 21 or older.

    The best option for you to get your younger child Green Card status is for your or your wife to be residing in the U.S. with a status which allows you to petition your younger son.
