  • Extended family + extension time

    Hi,

My friend has recevied notification of approval of his family-based Green Card filed by his sister. He is married with two children.

    1. Does the approval extend to his wife and Children?

    2. Oce he receives the notification? How long does he have to complete the next step in the process? Would it be possible, for example, for him to stay in his home country forone more year before he moves to the US?

    Thanks for any replies!

A sibling visa category allows for family members (wife, children) to obtain derivative visas to leave at same time or after the primary applicant receives his visa.

Once at the National Visa Center for sponsorship and civil document submittal, up to a year can pass between contacts to the NVC.

Once the visa is issued, it has to be used within six months of the medical exam.

If sibling is eligible for an immigrant visa 12 years from now. Will the kid who is 14 now (will about about 26 yrs old at that time) be able to get the derivative visa? Thanks.

The child will have "aged out," turned 21, and will not be eligible for a derivative visas.
