  • I-864 tax returns from intended immigrant/spouse

    Hello All, this is my first post and will be grateful if you can help me. My wife is USC and unemployed with no income. She was student and dependent on her father all these years so no tax returns for her.

    I am working/intending immigrant meeting income requirement and entered info under household income.

    For question 13, it is required to submit recent tax return copy. And the way question is framed it seems are they asking from my wife? Or can it be mine ? I am really confused about this question 13.

    Ron,

    Assuming your wife is the petitioner for you, she must be the primary sponsor, with or without income, and complete an I-864.

    You can be a "household member" joint sponsor if you have legal authority to work in the U.S. If that is the case, she would list you in the I-864 as a contributing household member, and there must be a separate I-864A for you, which you both sign on page 3.

      Thank you Ray, in point 12, it says I do not need to complete I-864A because he/she is intending immigrant and has no accompanying dependents.

        If you are legal to work and your wife's income doesn't meet the sponsorship requirements, you can contribute to the sponsorship requriements with your income and with an accompanying I-864A.

          Thank you very much, now I get it. I was only reading form I-864 which says intended immigrant do not need to file I-864A which had me confused whole time, until I saw I-864A form with option - I am intending immigrant and also the sponsor's spouse.
