Few questions I would like to ask..

Hello Everybody,

I have few questions that at some point are a riddle for me. I'm from Macedonia.

Please, can somebody answer me these questions:




1. My brother lives in US and he's about to apply for me for Green Card, how long is going to take that process?

2. Right now I have a 10 year tourist visa, how my brother's application for Green Card will affect my tourist visa? Can I still use my tourist visa and go to US, while the petition is pending?

3. What options do I have while being in US and waiting for the Green Card approval?

4. Can I get a student visa or H1B visa? Can I leave the country?

5.While my petition is pending, can my husband apply for tourist visa?

Nina,

1.There is a twelve-year wait for a sibling visa (petitioned by a U.S. citizen) to be eligible for a quota-based sibling visa slot (F4). The petition would be approved by USCIS in a matter of 6-11 months, but the application would then sit at the National Visa Center until a quota slot is reachable for your Priority Date.

2. Your tourist visa is not automatically cancelled, but you risk having it cancelled if Port of Entry officers are aware that you have an immigrant petition being processed, because you will have expressed "Intent to Immigrate."

3. If you are in the U.S. on a visitor visa, you have no legal basis for working or getting a Green Card, unless you marry a U.S. citizen or are able to convert to an employment-based visa status.

4. Your husband can apply anytime, but if his wife (you) are in the U.S., his application may be perceived as an attempt to circumvent normal immigration requirements and be denied.
