  • Joint sponsor and filing out I-864

    Hey guys

I am filing out the I-864 for the joint sponsor we have. The joint sponsor filed as married filing jointly.
-The joint sponsor does not make enough income on his own but together combined with his wifes income, its enough to sponsor me.

    I have a few questions

    1) for part 6 where it asks for current individual income I will only put my joint sponsors income for 2014, correct?
-And then under 6a I will fill out his spouses names and then put her income there and then total both together for total household income?

    2) For part 6, 13 a b and c where it says fill in the total income, I am filing out the total income as it shows on the transcript right? not total income for 2013 for just my joint sponsor but rather the total income of him and spouse together as they filed jointly?

    3) Since my joint sponsor doesnt make enough on his own, and they filed their taxes married filing jointly I will have to fill out a I-864a for the spouse to sign correct?

    4) I have the tax transcripts, do I need to submit any other schedules? (Schedule C? The instructions is throwing me off, it says if you checked that you are seld employed that you must also include any 1040 schedule that I filed). But I think with tax transcript i should ignore that part? not sure

    Thank you in advance

YOU MUST SUBMIT YOUR OWN I-864 AS PRIMARY SPONSOR. YOUR CO-SPONSOR SUBMITS A SEPARATE I-864 AS A JOINT SPONSOR, AND HIS WIFE WILL SUBMIT AN I-864A. HIS I-864 WILL INCLUDE HIS WIFE'S NAME AND INCOME, AND THEIR TOTAL INCOME WILL BE THEIR COMBINED INCOMES.

    2) For part 6, 13 a b and c where it says fill in the total income, I am filing out the total income as it shows on the transcript right? not total income for 2013 for just my joint sponsor but rather the total income of him and spouse together as they filed jointly?

ASSUMING THEY FILED JOINTLY, YOU WILL USE THE TRANSCRIPT TOTAL INCOME AMOUNT FOR REPORTING THE TAX RETURN TOTAL.

    3) Since my joint sponsor doesnt make enough on his own, and they filed their taxes married filing jointly I will have to fill out a I-864a for the spouse to sign correct?

RIGHT. HE SIGNS HIS I-864, AND THEY BOTH SIGN I-864A.

FOR SELF-EMPLOYED, THE IRS TRANSCRIPT TAKES THE PLACE OF A TAX RETURN COPY, BUT YOU MUST ALSO INCLUDE PROOF OF CO-SPONSORS U.S. STATUS (RESIDENCY OR CITIZENSHIP), INCOME SOURCE DOCUMENTS, PROOF OF LEGAL BUSINESS ENTITY, A FEW RECENT BANK STATEMENTS TO SHOW BUSINESS CASH FLOW.

    Thank you in advance

      Thank you for you answers!

Final question before I mail this sucker out, there are a lot of blank sections on the I-864 form, should I put "NA" in any blanks on the form or just leave it?

I've read people getting checklist for leaving something that doesn't apply as blank instead of putting NA, mostly when filing the I-864ez form. But I'm sending the I-864. What are your thoughts? Should I put NA on any blanks?

      Thank you

        Itstaran,

No one answer fits all. Some I-864 response areas can remain blank, others may need "N/A" or "None." Nobody can give you a general answer to this question without seeing your form. The form is 9 pages long.

          Hey Ray

So I have already sent my package but was reading sometbing and realized if someone files the I-864a they need to show proof of relationship?? I didn't send that

My joint sponsor filed the I-864 and since they filed married jointly and wife's income combined with joint sponsor is enough to meet the threshold we filed the I-864a for the wife.

Did we mess up by not sending proof of relationship? I thought since they filed married jointly they didn't need to show proof of relationship?

          Any input??

          Thank you.

When submitting I-864 and I-864A, the latter for the spouse, proof of relationship to each other is not needed. But both need to include proof of U.S. citizenship or Green Card status.

Ah, jsut read the last part of your response. I only sent my joint sponsors proof of citizenship since all the instructions advised as such. Did not send his spouses proof of citizenship.

Man, I hope it doesnt get a checklist. I am tired of these 60 day wait times

anyone out there to clear these for me please

                    I truly appreciate your help.

                    1) My wife' cousin who is joint sponsor and has filed his IRS (2014) as married filing jointly. So there total income from line 22 is combined(husband and wife) . Now while I am filling the form I-864 part 6- 2 asking current individuals annual income. My question is what amount shall I use here? Total amount from line 22 or only his alone income ?

                    2) if I need to put his individual annual income ( not including his spouse income) than in that case do I need to put in part 6--3 his wife name and her income as well as her i864a saparet ?

                    3) if I need to put his individual annual income in part 6 .2 and her spouse individual income in part 6.5... How can I calculate an individual income from IRS line 22 ? As the line 22 income comes after many deduction from wages , salaries and all w2

                    4) I spoke with nvc about which year IRS do I need to send and they said only 2014 if I send before April 15.. If I send after that than I need to send 2015 IRS. Would you please advice me on this what to do?
Thank you so for your kind and spot on reply

Affidavit of Support-(Sponsor married taxes filed jointly-Urgent Please help!!

                        Hello,

I have a few questions actually. My husband is the petitioner and his income was not sufficient to cover myself and my son so his sister is assisting, however she filed her taxes jointly as a married couple.

                        1. Part 1 of I-864 should she indicate 1d as the only joint sponsor or 1e as the first and her husband would need to file a separate one and indicating he is the second?

                        2. If she is the only joint sponsor, would the husband need to complete I-864A as well?

                        3. If so, would the husband be classified as the household member and would she need to sign on same form as the sponsor?

                        4. If she is the joint sponsor because my husband income is not sufficient, would he still need to complete any additional information such as assets, income information or re-submit new forms etc?

                        5. Since it is two persons (wife and son) that would be total on item number 28 on I-864 correct that she will be sponsoring?

Any information would be greatly appreciated

                        SPPTene'

                          Married joint sponsor

My friend wants to be a join sponsor for my mother, He is married but separated(not legally). His wife has listen their children as her dependents and the only dependent my friend has is his father. When it comes to part 5 question 3 of I-864. Does he still has to put a 1 indicating he is married?

just read everything i'm kinda confused... couldnt find here straight answer to my problem.. I'd like to ask here again.. same problem I have joint sponsor and he filled tax return jointly with his wife(we dont need his wifes's income )...

I guess we need i864 for joint sponsor, i864 already sent for my wife(usc) and i864a for joint sponsors's wife.

can we DO NOT send i864a for joint sponsor's wife??? joint sponsor's income is enough..

                              Akaur,

If you are the petitioner for your parent(s), you should complete an i-864 and your husband completes I-864A.
For a tax return copy, line 22 of form 1040 is used. If you used 1040A or 1040EZ, it's total income for 1040A and Adjusted Gross Income for 1040EZ.
You each should include copy of Green Card or Naturalization Certificate or copy of U.S. passport (or U.S. birth cert). There is no requirement that a marriage cert copy be included.
You should include your W2 copies and husband's 1099-MISC copies.

                              --Ray B
