  • Concurrent filing of I-130, I-485, I-131, I-765

    Hi,

I'm going through this whole process right now, just completed the package myself with no help from immigration attorney ( too expensive !!) so I am kinda nervous.

    Background
I am currently on a F1 student VISA. I was on OPT few months ago but ended up not using it and started a higher program so I am back to a regular F1 now. In June married a US citizen by birth. My husband and I have been working on gathering documents and paperwork and we finally got the whole package done! We are planing on sending it in the next few days. I hope you can give us some comments on our package.

    Big questions is:

I divided our package into 4 sub package I-130, I-485, I-131, I-765. A lot of documents within these package are redundant of each other. For example, I have "Copy of beneficiary’s passport, nonimmigrant visa page, I-94, current I-20 and previous EAD card" in almost all of my package. Is this necessary or will this hurt?

your reply looked concerning... We are doing the exact same thing now and have some questions if everything went well. We aren't sure how to package everything. A paperclip for each form package? all shipped in a big manilla envelope?

I know this person is probably not on the board anyone more is there anyone else who would not mind sending a .doc of their cover sheet? I am claiming for my spouse and we are filing concurrently. We still aren't sure exactly how to package everything.

          I-130
          g-325a for me
          g-325a for her
          g-1145

          i-485
          i-693
          i-765

A series of questions if anyone knows the answer:

-Will papercliping each section work or do we need to staple? What about binder clips?
-The 325s are suppose to be filed with the 130 but does that mean they should be paper cliped or stapled together?
-Should the 485,693, 765 and ALL of their necessary documents be one big clump? Then there would be a clump for the 130, 325s and supported docs?
-Does anyone have pictures of how they put everything together?
-How do we attach the envelope for the completed 693?
-Do we file an 1145 with both the 130 and the 485?
-My wife used to have a social security number when she was in the US on a student visa (F1) and got a social security number with her accompanying work permit (OPT). However, her F1, OPT and social security number have all expired. Does anyone know if we should leave the social security number for her on all of the immigration forms blank or put the expired SS number?

This is less for a firm yes or no:
Does the 30-60 day "rule" apply to the date of our marriage or to the date of our filing? She entered the US to visit on a B2 and then we decided to change our plans and get married a few weeks after she got here. Does this 30-60 consideration look at when someone enters to their marriage date or from when they entered to their filing date?

          Thanks in advance!
