  • Get a baby while waiting for priority date

    Hi, everyone,

    My wife's PD: Sep. 11, 2013;

    Everything got approved at USCIS. We submitted forms and documents to NVC in late 2013, and we got an email from NVC in Feb. 2014 saying that our case has been sent to the US. Consulate in Guangzhou -- Mainland China.

    Since then, we did not get anything from NVC. Is that normal?

    A few weeks ago, we got a baby in China. Now with the movement of the PD date, I wonder:

    1. If the PD is moving too slow, I would like my wife and the baby to come to the U.S. before my wife's consulate interview. Does the baby need a Visa?

    2. If the PD is moving OK and she would like to wait for the consulate interview, what should we do with the Baby? My wife submitted her VISA application last year to the NVC; at that time, we don't have the baby. Now we have the baby, but she is still waiting for the PD to become current. What should we do? Should we contact the NVC and resubmit a VISA application (to include our baby) or should we submit a new application for the baby? Please advise.

    Thank you in advance for your help.

    Were you a U.S. citizen or Green Card petitioner?

    Either way, the baby will need a visa. But if you are a U.S. citizen, you need to submit a new petition for the baby. If you were a Green Card petitioner, the child is elgilble for a derivative child visa.

    Did you get an interview date assignment in the NVC letter which told you the case was being forwarded to Guanzhou? That is the normal process.
