  • New immigrant travel abroad rules

    Hello

    I recently landed in the US on PR (Permanent visa) with my family. We belong to India. My daughter has an important exam to attend, which got pre-scheduled to mid of Oct'14. Can she visit India, write the exam and return to the US? Will there be any problems with her PR status?
    Please clarify. Thanks in advance for the guidance.

    if she has received her green card, yes, she can. If you are a new PR , it does not mean you cannot travel abroad. She will need her card to re-enter US again.

      Actually, the I-551 stamp on her passport from her original entry, should allow her to reenter without the Green Card, but she will be asked why she doesn't have it yet. This is assuming she came in as an immigrant and did receive an I-551 entry stamp, which automatically report a one-year immigrant status, pending receipt o the Green Card.

        We landed in the US only few days back. I understand it takes normally 30 days for the green card to come. So, my daughter would definitely need the green card to enter back to the US?

          Maybe my message wasn't clear. If leaving the U.S. before her Green Card arrives, your daughter can reenter the U.S. without a Green Card by using the I-551 arrival stamp in her passport as proof of temporary Permanent Resident status.

          Assuming you have paid the Green Card issuance fee online, $165, the Green Card could take up to 90 days to show up.

            Thanks for the clarification. Yes, I did pay $165 towards Green Card issuance fee few weeks back.
